Questions

Is this an electronic signature?

In the broad sense of the law it is an electronic signature method, but it is not the qualified electronic signature used for e-Government services or the financial seal. It is not suitable for work that requires a qualified electronic signature.

Is there a time stamp?

No. A hash of the document is taken before and after signing, and the activity records are chained to each other.

How is the signer’s identity checked?

If you wish, with a one-time code sent to the signer’s phone. This shows that the phone receiving the code is with the signer; no ID card or face check is done.

How is a signed document assessed in a dispute?

The activity report and the signed PDF are documents within the meaning of Article 199 of the Turkish Code of Civil Procedure (Law No. 6100). Because they do not carry a qualified electronic signature, they do not count as a deed. The court weighs them at its discretion together with the document hashes, the verification code and the activity records.

Can I have a lawyer’s fee agreement signed with E-contracts?

Article 163 of the Turkish Attorneys’ Act does not make written form a condition of validity for fee agreements; agreements not in writing are proven under the general rules. A signature made on screen is not a qualified electronic signature, so it does not have the force of a deed; in a dispute it is weighed as discretionary evidence. For high-value fee agreements we recommend a wet or qualified electronic signature.
